Alan is a Partner in the Property Litigation team.

Alan has over 25 years’ experience working with commercial landlords and tenants, as well as local authorities and developers. He provides advice on all types of contentious property issues, in particular focussing on disputes and litigation between landlords and tenants, including disputed lease renewals under the Landlord and Tenant Act 1954, claims for vacant possession, dilapidations, service charge disputes, boundary disputes, and restrictive covenants.

He has a particular expertise in disputes between telecoms mast-site operators and landowners relating to the level of rent and terms of operation, including the application of the new Electronic Communications Code that was introduced in 2018, having acted in a number of recent cases before the Upper Tribunal (Lands Chamber), as well as seeking the resolution of such disputes through negotiation.

Recent examples of how Alan has supported clients include:

  • successfully negotiating substantial compensation for a client as a result of subsidence caused by adjacent mining activities;
  • securing the removal of a tenant freeing up a substantial site which was then sold for residential development;
  • securing a very substantial rent reduction for a telecoms mast operator seeking to secure a rooftop site in one of the first cases under the new Electronic Communications Code; and
  • successfully resisting a landlord’s claim for possession of a telecoms site in a proposed redevelopment scheme, including obtaining a substantial costs award against the landlord.
