Fabienne is a Partner in the Employment team.

Working with businesses and senior executives, she supports on the resolution of employment disputes and on the enforceability of post-employment restrictive covenants and confidentiality agreements.

She provides support through the grievance and disciplinary process, negotiates employee exit arrangements and settlement agreements, brings and defends Employment Tribunal proceedings and assists in applications for permanent or temporary injunctive relief.

Her experience includes the resolution of disputes concerning director-shareholders, and those which raise allegations of unfair dismissal, discrimination or breach of equal pay rules.

Fabienne also advises on the TUPE aspects of corporate transactions and on collective and individual consultation with employees in the context of redundancy programmes triggered by company or group restructuring.

In addition, she helps to create employment policies and procedures and draws up standardised and bespoke employment contracts and directors’ service agreements.

She is bilingual in English and French and holds both English and French law degrees.

Her clients include large companies, SMEs and international organisations with a UK presence headquartered in France, Germany and the USA.

Recent examples of how Fabienne has supported clients include:

  • securing the swift settlement of a complex equal pay claim which threatened to spoil the client’s hard-earned reputation as a trailblazing equal opportunities employer;
  • facilitated the amicable re-organisation of local leadership for an international organisation to better align personnel with corporate strategic initiatives; and
  • negotiating a commercially attractive severance package for a director-shareholder who had been unfairly ejected from a company he had helped establish, and securing revisions to restrictions within his service agreement to enable him to set up again on his own account.
