Hayley is a Senior Associate in the Restructuring & Insolvency team.

With a wide variety of experience in contentious personal and corporate insolvency and commercial debt recovery with an emphasis on investigations and asset realisation in the context of bankruptcy.

Supporting insolvency practitioners, company directors, private individuals, companies, creditors and financial institutions in relation to asset recovery, antecedent transactions such as transactions at an undervalue, preferences and transactions defrauding creditors, directors’ conduct and misfeasance claims.  Hayley also has extensive experience in advising on trust and property issues in bankruptcy and bringing proceedings to recover the bankrupt’s assets for the benefit of the bankruptcy estate.

Recent examples of how Hayley has supported clients include:

  • advising a trustee in bankruptcy in relation to a potential transaction at an undervalue and a preference claim where the bankrupt had exercised her right to buy her home and then proceeded to transfer the property to her son and his wife;
  • successfully obtaining an order for possession and sale of a bankrupt’s property where his ex-wife was claiming a beneficial interest in the property;
  • settling a claim on behalf of the liquidators of a company in relation to various antecedent transactions involving the directors of the company; and
  • drafting the documentation to transfer and sell the intellectual property of a company in liquidation.
