Nick is a Partner in the Property Litigation team.

Experienced in working with clients on strategic and contentious property matters, including commercial lease renewal matters (both opposed and unopposed), lease and freehold covenants, rent reviews, exit strategies, including the exercise of break rights, insolvency-related property issues, rights of way matters, mixed-use schemes, dilapidations, statutory obligations, forfeiture and possession actions.

In addition, Nick specialises in leasehold enfranchisement matters, including advising on lease extensions, compulsory acquisition actions and obligations under the Landlord and Tenant Act 1987 relating to tenants’ right of first refusal.

Recent examples of how Nick has supported clients include:

  • working with an offshore trust company and owner of freehold commercial premises in London in a dispute with its tenant, a major bank, concerning the grant of third party rights to and/or sharing of occupation with a telecommunications company;
  • a multi-party dispute connected with the liabilities of a company as former tenant of commercial premises. The company formed part of assets our client sold to a third party under an SPA and the dispute concerned amongst other things our client’s liabilities under the warranty provisions contained in the SPA;
  • representing the owner of a prime central London flat in a private prosecution under the Environmental Protection Act against a chain of London restaurants concerning noise and odour pollution caused by the restaurants; and
  • defending a central London restaurant in a claim for breaches of the alterations provisions within the two leases (held with separate landlords) under which the restaurant was occupied.
