Nicole is an Associate in the Residential Property team.
Working with first-time buyers, high-net-worth investors, private and commercial landlords, she helps with buy-to-let property portfolios, advising on the sale and purchases of freehold and leasehold residential property and land.
She resolves complex title issues, assists with adverse possession, and relief from onerous covenants restricting use or development. In addition, she advises on extensions and variations of a lease for sale, mortgage and financing purposes, transfers of equity subsequent to divorce and for tax-planning purposes.
Support to clients includes negotiating on their behalf with developers and lenders on variations to standard lending provisions to facilitate financing, and advising on help to buy loan schemes to assist first-time buyers, help to buy ISA schemes, and on shared ownership transactions such as staircasing, building towards outright ownership.
Recent examples of how Nicole has supported clients include:
- securing a client’s dream home by negotiating an exclusivity agreement with the vendors after the sale of the purchasers’ property fell through, completing the subsequent sale to a tight schedule;
- saving a client over £20,000 in stamp duty by applying multiple dwellings relief to a property purchase that included a basement flat;
- protecting the new owners of a Grade II listed building from costly liability for unapproved alterations by insisting the sellers gain retrospective listed building consent rendering the property mortgageable; and
- facilitating the buy-to-let purchase of a building as a house in multiple occupation by negotiating a variation of restrictive use covenants on occupancy and use, which had been rendering the deal financially unviable.
