Thomas is a Senior Associate in the Property Litigation team.

He has extensive experience supporting clients with property interests across all forms of property related disputes.  This includes lease renewals, the exercise of break options, the enforcement of landlord and tenant covenants and other covenants attached to land, dilapidations, boundary disputes, disputes about rights of way and rights of light and the Electronic Communications Code. 

His experience extends to large complex commercial disputes (many of which arise from or involve property transactions), including breach of contract, professional negligence claims and cases of unfair prejudice.

Clients include property developers, landowners, private individuals and estate agents as well as clients across a range of sectors such as manufacturing, healthcare and charitable organisations. Including Harworth Estates Investments Limited and Sharpsmart Limited.

Recent examples of how Thomas has supported clients include:

  • successfully acting for a client in a 5-day trial in the County Court to establish a right of way by prescription across the front of a neighbour’s property and successfully resisting the neighbour’s subsequent appeal to the High Court;
  • defending and subsequently settling a High Court claim for the return of a £175K deposit paid by purchasers towards a property transaction which they subsequently failed to complete;
  • successfully resisting an application by a tenant for an interim injunction to prevent the demolition of an unsafe property, notwithstanding that their tenancy at the property was still ongoing; and
  • acting on behalf of a property developer to secure the removal of telecoms equipment from a development site pursuant to the new Electronic Communications Code.
