Since lockdown measures were introduced, much has been done by national and local government to adapt the planning system so it can “work” during this time. Emergency regulations and guidance continue to be issued to deal with the impact of the current situation on a broad spectrum of planning matters.
One area, however, begging for legislative attention is the automatic expiry of a planning permission after 3 years from the date of grant (if it hasn’t been implemented). Currently, with restrictions in place (albeit a little loosened), there is a real risk to developers that precious planning permissions will be lost because there isn’t enough time to clear pre-commencement conditions or they simply can’t get on site to start development. How can this be dealt with?
