Service overview

What we do

The Court of Protection makes decisions for people who cannot make particular decisions for themselves. We advise families, attorneys, deputies and other interested parties on applications involving property, finances, health, welfare and capacity.
Our work includes deputyship applications, urgent and interim orders, statutory wills, authority for significant gifts or transactions, mental capacity evidence, disputes concerning attorneys or deputies, and challenges relating to a person’s care or best interests.

How we can help

We guide you through the evidence, forms and safeguards required, coordinate with medical and financial professionals and present the application clearly to the court. Where there is disagreement, we focus on the individual’s best interests while helping families understand the available options.
The process can feel demanding at an already difficult time. We provide careful, responsive support so that important decisions can be made lawfully, sensitively and without unnecessary delay.

Resolving concerns about appointments, conduct, removal and the management of another person’s affairs.

Advising families and representatives where care arrangements restrict a person’s freedom.

Applying for full, interim and urgent authority to manage property, finances, health or welfare.

Supporting applications and disputes concerning care, residence, treatment and contact.

Advising on assessments and contested questions about a person’s ability to make particular decisions.

Helping deputies meet reporting, safeguarding and financial-management responsibilities.

Acting as a court-appointed deputy where independent management and oversight are appropriate.

Seeking authority for wills, gifts and estate-planning decisions where a person lacks testamentary capacity.
