Bio

Elliott is a Disputes Associate.

Elliot works with a diverse client base spanning large UK-based companies, SMEs and private individuals.

He advises claimants and defendants across a range of matters including the breakdown of contractual relations between suppliers and customers, contractual construction and interpretation, and the consideration of termination or debt recovery strategies. He is also experienced in pursuing debt claims, alongside advising commercial landlords in connection with termination rights and private individuals on adverse possession of land.

Elliott oversees matters from pre-action all the way through to trial, including assisting with instructions on urgent applications for injunctive relief in the High Court, and making tactical interlocutory applications as cases progress. He is also experienced in acheiving settlements through mediation, offers, and direct settlement negotiations with opponents’ legal representatives.

Examples of Elliot’s work include:

  • Successfully terminating a retailer agreement for the supply of liquefied petroleum gas where multiple breaches of the agreement had been identified.
  • Advising a UK-based broadband provider on its prospective liabilities under a complex, multi-schedule contract for the provision of deployed services, including the consideration of agreed variations over the lifetime of the contract.
  • Achieving the dismissal of a bankruptcy petition issued by HMRC again our client, including securing the adjournment of multiple hearings prior to payment being made.
  • Assisting with a claim for breach of contract arising from the termination and (prior) performance of a five-year Sponsorship Agreement, including a substantial debt element.
  • Preparing for, and attending, a fully-contested three-day trial concerning the adverse possession of a parcel of unregistered land at the entrance to a client’s property, which also served a neighbouring property.
  • Advising trustees of a retirement benefit scheme in relation to their expressly reserved forfeiture rights under a commercial lease, leading to the lease subsequently being forfeited by way of a peaceable re-entry.
