Lois McCartan

Lois acts on behalf of both national and regional housebuilders and landowners – supporting clients with the acquisition and sale of land for development.

She deals with conditional contracts, option agreements, development agreements for the sale of affordable housing to registered providers and infrastructure agreements. She also assists in the drafting and negotiation of ancillary documents such as legal charges and overage agreements.

Lois has wide experience of site set-up, and works to ensure smooth transition of information for the onward disposal of plots.

She also supports clients with the transfer of managed land, including assisting with the negotiation of management agreements and transfers.

Examples of Lois’ work include:

• Negotiating, agreeing and completing several option agreements with different landowners and simultaneously exercising the options for a large joint venture residential development with two national housebuilders.
• Overseeing a purchase under two separate option agreements and the simultaneous onward sale of land for residential development.
• Overseeing the phased purchasing of land for residential development under an option agreement and, simultaneously, the drawing down of funding under a revolving funding agreement to fund the purchases.
• Negotiating the variation of an option agreement before exercising the same to purchase phase two of a three-phase residential development.
• Reviewing a title for purchase and overseeing the re-option of unregistered land for residential development, preparing a legal report, helping to amend and negotiate the contract, and drafting and negotiating ancillary documents.
