Bio

Emma is a Real Estate Disputes Associate.

Emma advises on a broad range of commercial and residential property disputes, acting for landlords, tenants, developers, businesses, investors and private individuals.

She supports clients in resolving complex and often business-critical property issues, providing practical and commercially focused advice designed to protect their interests while achieving the best possible outcome.

Emma is experienced in all aspects of property management litigation, with particular expertise in commercial property litigation and commercial landlord and tenant disputes. This includes lease renewals under the Landlord and Tenant Act 1954 and interim rent disputes, break notices, forfeiture, recovery of rent and other lease liabilities, dilapidations, enforcement of lease covenants and wider landlord and tenant disputes.

Emma has supported commercial clients in urgent and sensitive trespass claims in the High Court to achieve forthwith possession orders. She also advises on assured periodic residential tenancies, disputes relating to rights of way, restrictive covenants, adverse possession, trespass, private nuisance and beneficial ownership claims.

She has also supported private individuals in resisting repossession from mortgagees, securing the removal of spurious charges to their property titles, and negotiating the release of property from Law of Property Act Receivers.

Examples of Emma’s work include

  • Representing a commercial landlord in bringing a claim for trespass in the High Court against unknown persons whose trespass gave rise to risk to the general public, property, public infrastructure, and transport.
  • Representing a residential long-leaseholder in an action against their public-body landlord in respect of a disrepair claim which had been ongoing for many years, and had resulted the property becoming unsafe to let and uninhabitable.
  • Advising a commercial landlord in respect of terminal dilapidations, merits, prospects and settlement, together with advising on the terms of a Dilapidations Settlement Agreement.
