Bio

Andrew is a Disputes Partner.

Andrew supports clients with the resolution of wills, trusts and estate disputes.

He advises both private individuals and families on inheritance, estate and trust disputes where the issues are personally significant as well as financially important. This also extends to personal representatives and trustees, including advising on duties, decision-making, applications for directions, inventory and account issues, missing beneficiaries, and allegations of breach of fiduciary duty.

Andrew also advises beneficiaries and disappointed parties by pursuing and defending claims involving will validity, will interpretation, rectification and claims under the Inheritance (Provision for Family and Dependants) Act 1975.

Examples of Andrew’s work include:

  • Obtaining a finding by a High Court judge that an executor was in contempt of court for failing to provide an account of his administration of the estate which led to a distribution to the client and a substantial costs award in her favour.
  • Successfully challenging a will under which our client was disinherited on the basis the will had not been properly executed which led to an application to revoke the grant of probate and agreement that the estate is to be administered under a previous will under which the client is the residuary beneficiary.
  • Successfully resisting a challenge to the validity of a will on the grounds of lack of testamentary capacity and undue influence, so that the client was able to transfer ownership of the deceased’s property into her name.
