Bio

Clare is a Real Estate Disputes Partner.

Clare specialises in property litigation, advising on a broad range of residential and commercial disputes, with a particular focus on landlord and tenant matters and property management issues.

Her work spans both England and Wales, and she is regularly involved in matters where an understanding of the differences between the two legal regimes is critical, particularly in light of the Renting Homes (Wales) Act 2016.

A significant part of Clare’s practice involves supporting landlords, tenants (including RTMs), managing agents and property owners in the effective management of residential portfolios. This includes advising on the full lifecycle of tenancies, from drafting and implementing tenancy arrangements (including assured periodic tenancies) through to resolving disputes and securing possession where required.

She is also experienced in dealing with more complex leasehold issues, including long leases, service charge disputes, and matters involving Right to Manage (RTM) companies.

Examples of Clare’s work include:

  • Acting for a landlord who was in dispute with the leaseholders/RTM regarding alleged water ingress at the property, requiring detailed and strategic advice regarding the functions of the RTM and the obligations of the landlord in relation to the condition of the property.
  • Acting for a residential landlord who had failed to comply with statutory requirements at the outset of a tenancy and therefore could not pursue a no-fault eviction but needed possession, culminating in successfully obtaining a possession order within three months of being instructed and an order for costs.
