Emma is a Commercial Real Estate Senior Associate.
Emma’s expertise spans the legal aspects of rural land ownership, its use, and occupation, including the blending of specialised property, business, and agri-environmental law to support farmers and landed estates.
Emma advises and assists estate owners and farmers to navigate the complex intersection of rural enterprise, generational continuity and evolving land regulations.
She advises the farming community on complex property transactions, land management and regulatory compliance, and supports farming families on their property planning for the next generation to ensure the family farm and business is safely passed down to future generations.
Emma also advises farmers on their landlord and tenant matters and helps them to navigate the complex area of the Agricultural Holdings Act, and guides landlords and tenant farmers through the succession process.
Emma also drafts agreements to formally end old Agricultural Holdings Act tenancies in exchange for restructuring the farm into a modern Farm Business Tenancy, or settling lump-sum compensation for the tenant.
Examples of Emma’s work include:
- Acting on the sale of a listed farmhouse, 300 acres of farmland, and several cottages owned by multiple entities, and subject to Farm Business Tenancies.
- Overseeing the acquisition of a Grade 1-listed moated castle and surrounding farmland.
- Advising on the sale of farmland subject to an Agricultural Holdings Act tenancy which had to be terminated.
- Acting on the appointment out of a deceased’s estate of a listed farmhouse and cottages, farmland and land subject to commoners’ rights, all of which were unregistered.
- Advising on the partitioning of a farm with farmhouses and farmland subject to overage provisions.
