Andrew is a Partner in the Dispute Resolution team.
He provides specialist support in two key areas:
- Supporting private individuals in disputes concerning estates and trusts; and
- Acting for businesses in disputes concerning compliance with data protection obligations.
Andrew enjoys the contrast between probate and trust law, often developed over many years through previous court judgments, and the evolving regulatory world of data protection compliance.
Andrew regularly advises on disputes concerning the validity of wills, claims under the Inheritance (Provision for Family and Dependants) Act 1975, applications against executors/trustees for an account or breach of trust, the rectification or construction of wills, and cases in the Court of Protection.
In addition to private client matters, Andrew has significant experience supporting businesses in responding to data breaches, assessing whether the threshold for notification to the ICO has been met, liaising with the client’s insurers and defending claims for damages
Examples of how Andrew has supported clients include:
- successfully resisting a challenge to the validity of a will on the grounds of lack of testamentary capacity and undue influence, so that the client was able to transfer ownership of the deceased’s property into her name;
- acting for an attorney for property and financial affairs in an application to the Court of Protection for authority to execute a statutory will; and
- advising a company which had suffered a cyber-attack, drafting notifications to the ICO and regulators in other jurisdictions, drafting communications to data subjects, and dealing with claims that were then threatened.
