Elliot is a Senior Associate in the Property Litigation team.
He specialises in resolving real estate disputes for both commercial and residential property clients, advising on a broad range of contentious property issues. Elliot acts for high-net-worth individuals, business owners, property portfolio investors, and developers.
His expertise encompasses:
- Residential and Commercial Landlord and Tenant – including forfeiture, rent recovery, dilapidations, service charge disputes, possession, lease renewals, break options, applications for consent for alterations or assignment, major works, and enforcement of covenants.
- Real property – including trespass, nuisance, boundary disputes, adverse possession, overage disputes, rights of light, building defects, and interference with easements.
- Disputes between co-owners of property – including applications to determine the beneficial interests of co-owners and seeking orders for sale pursuant to TOLATA.
- Professional negligence claims – including those that arise from underlying transactional property errors, predominantly against surveyors and conveyancing solicitors.
With prior experience also in commercial litigation and having obtained Higher Rights of Audience, Elliot has built his career in dispute resolution from the outset. His experience ranges from First Tier Tribunal and County Court proceedings to High Court claims, including urgent injunction applications. He is recommended by clients for his pragmatic and commercial approach to finding solutions in real estate disputes, often by way of alternative dispute resolution, such as mediation. He is also a member of the Property Litigation Association.
