Specialist knowledge in Court of Protection matters supporting vulnerable persons who lack the mental capacity to manage their own affairs, dealing with the Court of Protection and advising both lay and professional attorneys and deputies.

Clients include private individuals, business owners, executors and administrators, beneficiaries, trustees and lay and professional attorneys and deputies.

Examples of how Emma has supported clients:

Advising in respect of a complex intestate estate with multiple beneficiaries, obtaining letters of administration and instructed to prepare a deed of variation in light of succession planning advice provided.

Drafting Court of Protection application for the appointment of a lay deputy in respect of a vulnerable person’s property and financial affairs.

Preparing a will and advising on inheritance tax implications and possible exemptions for a high net worth individual with interests in several UK based companies. Working closely with colleagues in the corporate department to ensure the client’s wishes in respect of his business interests could be achieved in line with his will.

Advising lay attorneys appointed under a registered Lasting Power of Attorney in respect of their ongoing duties, potential conflicts of interest and ensuring at all times that they acted in the best interests of the donor. Advising on the scope of their powers to sell the donor’s property and gifting.

Working with several generations within one family to advise on a family settlement agreement set up several years prior with a view to succession planning, protecting a beneficiary’s first time buyer status, navigating the Trust Registration Service and preparing lasting powers of attorney and wills to mitigate inheritance tax liability.
