Rachel is a Senior Associate in the Employment team.
Providing support on day-to-day HR issues, contracts of employment and directors’ service agreements, the management of employee performance, strategies for dealing with long term absence, redundancies following a business sale or corporate restructure, TUPE transfers, disciplinary and grievance procedures, exit arrangements for senior personnel and the negotiation of settlement agreements.
In addition, Rachel also deals with cases destined for the Employment Tribunal and is experienced in claims arising from alleged discrimination.
She acts for employers and employees, including senior managers and company directors.
Recent examples of how Rachel has supported clients include:
- settling an ill-founded unfair dismissal claim for a public sector organisation on commercially sensible terms, designed to avoid dealing with a difficult litigant in person;
- convincing an employee to withdraw an employment tribunal claim that had been brought in the mistaken belief that there had been a TUPE transfer of their employment following the partial sale of the employer’s business; and
- running a sex discrimination claim before the Court of Appeal for a father who was denied pay when he was forced to take time off work to look after his newborn child, in circumstances where he would have received company maternity pay had he been a woman (Ali v Capita  EWCA Civ 900).
